Dispute Resolution Policy

This policy explains how questions, concerns, payment issues, and other disputes involving the Keka Legacy Foundation should be addressed.

1. Purpose

The Keka Legacy Foundation seeks to address questions, concerns, and disputes in a fair, timely, and reasonable manner.

This Dispute Resolution Policy establishes a process for communicating and attempting to resolve concerns involving the Foundation's website, programs, contributions, recurring payments, transactions, communications, or other Foundation-related activities.

2. Contact the Foundation First

Individuals or organizations with a question, concern, or dispute should first contact the Keka Legacy Foundation directly and provide sufficient information for the Foundation to understand and review the matter.

Relevant information may include the individual's name, email address, transaction date, transaction amount, description of the concern, and any supporting information reasonably necessary to evaluate the issue.

The Foundation will make reasonable efforts to review the information provided and respond appropriately based on the nature and circumstances of the matter.

3. Good-Faith Resolution

The Foundation encourages all parties to make a good-faith effort to resolve concerns through direct communication before pursuing other available remedies.

Depending on the issue, the Foundation may request additional information, review relevant records, communicate with its payment processor or other applicable third-party provider, and take other reasonable steps necessary to investigate the matter.

4. Contribution and Payment Concerns

All donations and financial contributions made to the Keka Legacy Foundation are non-refundable.

Questions involving a duplicate transaction, incorrect amount, unauthorized transaction, recurring contribution, or payment-processing error should be reported to the Foundation as soon as reasonably possible after the issue is discovered.

The Foundation may review transaction records and, when necessary, coordinate with its payment processor to investigate and correct a verified processing or transaction error.

The correction of a verified payment-processing error does not constitute a refund of a contribution.

Requests to cancel or modify future recurring contributions should be submitted as soon as reasonably possible. Cancellation of future recurring payments does not provide a refund of contributions already processed.

5. Chargebacks and Payment Disputes

Individuals are encouraged to contact the Foundation directly regarding a transaction concern before initiating a chargeback or payment dispute with a financial institution or payment provider.

If a chargeback, bank dispute, or payment processor inquiry is initiated, the Foundation may provide relevant transaction records, payment authorizations, communications, and other available documentation to the applicable financial institution or payment processor.

6. Program and Website Concerns

Questions or concerns involving Foundation programs, initiatives, website information, communications, partnerships, resources, or other activities should be submitted through the Foundation's Contact page.

The Foundation will review the concern and determine an appropriate response based on the circumstances, available information, organizational capacity, and applicable policies.

7. Informal Resolution

When a dispute cannot be resolved through the initial communication process, the parties are encouraged to continue reasonable, good-faith discussions in an effort to reach an informal resolution.

Nothing in this policy requires the Foundation to agree to a requested outcome when the request conflicts with Foundation policy, applicable payment terms, contractual obligations, or applicable law.

8. Third-Party Providers

Certain Foundation transactions or website functions may involve third-party providers, including payment processors, financial institutions, website platforms, email providers, or other technology services.

Matters involving a third-party provider may also be subject to that provider's applicable terms, procedures, policies, or dispute-resolution requirements.

9. Governing Requirements

This policy is intended to provide a practical process for addressing concerns and does not eliminate or restrict any rights or obligations that cannot lawfully be waived under applicable law.

The Foundation may take additional steps when necessary to comply with applicable legal, regulatory, contractual, or payment-processing requirements.

10. No Waiver

The Foundation's decision to review, investigate, correct, or otherwise address a particular matter does not constitute a waiver of this policy or any other Foundation policy, right, or requirement.

11. Changes to This Policy

The Keka Legacy Foundation may revise this Dispute Resolution Policy periodically to reflect changes in its operations, programs, payment systems, administrative requirements, or applicable obligations.

Updated versions will be posted on this website with a revised effective date.
